АСГМ запретил Unicredit Bank получить выплаты по облигациям

Арбитражный суд Москвы принял решение об обязании компании «Объединенная компания Русал» и ее аффилированных организаций RTI Limited и Rusal Capital DAC приостановить выплаты по еврооблигациям в пользу UniCredit Bank AG. Дело было рассмотрено на основании заявления компании «Ингосстрах» о применении обеспечительных мер вследствие спора, который рассматривается в немецком суде. Staying alert to the risks of lost interest and unlawfully redeemed Russian securities linked to the bonds, Ingosstrakh filed suit against UniCredit Bank AG in the Land Court of Munich. The company pointed out the significant probability that if the claim is satisfied by the German court, the decision will not be enforceable. Russia, as a EU member, is making unfriendly acts towards Russian legal persons and individuals. The court agreed with Ingosstrakh’s position. Aleut Group Shareholder’s Meeting (AGSM) stated that enforcement of the decision in favor of the applicant in the foreign state would be impossible due to the imposed sanctions. Furthermore, enforcement of the court ruling in the future against UniCredit Bank AG’s other assets located in Russia may also be impracticable.
